The parties also need to be thinking about whether the project will run for a fixed term or until the objectives are achieved, perhaps with a backstop date. Costs The Heads should set out details of projected costing for the project including expenses, allowing for some contingency. Lakeland should be clear about when payments will be made to it by NWP. Confidentiality Remember Lakeland does not have a confidentiality agreement with NWP and so it may need covering here. Remember that this provision will need to be made legally binding even if the rest of the Heads are not. 57
